Terms and Conditions
APPLICABLE LAW
1. The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
2. In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
SERVICES PROVIDED
2. The Client hereby agrees to engage Evelina Si Photography to provide the Client with the following services (the "Services"):
A) Photo Session
B) Edited Digital images (on purchased packages).
3. The Services will also include any other tasks the Parties may agree on. Evelina Si Photography as a result of this agrees to provide such Services to the Client.
TERM OF AGREEMENT
BOOKING
4. The term of this Agreement will begin upon the booking fee or full payment, the Photographer shall reserve the time and date agreed upon. The Term may be rescheduled up to 48 hours before the session (subject to availability) consent of Evelina Si Photography.
5. By booking with Evelina Si Photography you enter a contract and have therefore agreed to abide by the terms and conditions.
6. The booking deposit (also called a booking fee) is required to book a session.
BOOKING FEE
7. The booking fee of £50,00 is non-refundable unless the session is cancelled by Evelina Si Photography or if is made up to 30 days before the event. In the event, that the client needs to cancel, the fee can be transferred to another date if Photographer has an alternative date available.
CANCELLATION
8. In case of an illness or misadventure, please call as soon as possible to reschedule. The request must be made no later than 48 hours before your scheduled booking otherwise the cancellation will cause a loss of the booking fee. A full booking fee will need to be paid to rebook. Evelina Si Photography maintains the right to reschedule at any time should it become necessary but will do our utmost to negotiate a mutually acceptable rebooking.
9. If either Party wishes to terminate this Agreement before the completion of the Services, that Party will be required to provide 30 days written notice to the other Party.
PAYMENT
10. Evelina Si Photography will charge the Client a fee for selected packages or an individual price of £25 per digital picture for the Services.
11. For the remaining amount, the Contractor will charge the Client on the day of the Session on arrival.
FREE MINI MATERNITY SESSION
12. This offer excludes brown package newborn bookings. A £49 deposit is required to book your newborn session. Once this has been booked, we will schedule your Free mini-maternity session with three digital pictures.
FULFILMENT OF OBLIGATIONS
13. Evelina Si Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises because of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.
14. The liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.
15. Evelina Si Photography shall be entitled to use its judgement regarding the style and artistic input in the production of pictures. This includes but is not limited to locations, poses and the number of images taken. Due to the vagaries of weather and the willingness of subjects it may not be possible to capture all the pictures requested, or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Evelina Si Photography may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.
16. Evelina Si Photography will not be held responsible if the Client fails to read and carry out the instructions sent in the supplied booking preparation email, before the session which may cause reductions in the quality or quantity of images supplied.
17. If the Client runs late, the total session time will be reduced by the delay time. The photographer is not responsible if the remaining time will not be enough to take the highest quality pictures or the appropriate number of photos.
18. If the Client is late longer than one hour without communication the session is cancelled, and no refund will be given on any session fee paid.
ELECTRONIC DEVICES
19. Cameras, phone cameras, and video are not permitted during any session unless approved by the photographer.
RAW IMAGES
20. Evelina Si Photography does not deliver images that have not been edited to the highest professional standard and the style of her portfolio.
DIGITAL IMAGES
21. Once your gallery has been issued, the selection of images must be finalized within 14 working days. Evelina Si Photography will provide you with assistance if required in choosing your images.
MODEL RELEASE/COPYRIGHT
22. Evelina Si Photography retains the copyright on all images and reserves the right to use the images for self-advertising, publication on social media and/or other purposes for our portfolio. The client warrants that she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of Evelina Si Photography. Under no circumstances, can a client use these images for profit, commercial endeavours, professional display, or in competition. Copying, snap shooting, saving or scanning images from the client's gallery, Evelina Si Photography website, or social media sites is considered stealing, regardless of the intent for use. If the client steals images via any method listed above, or any other method, the client will be invoiced for the cost of each digital image the client has stolen, at the photographer’s price of £100 per digital file.
SHARING
23. Sharing images and links on the web from its main source is highly acceptable and encourages you to show family and friends your beautiful images.
24. By making a booking you signing this contract, and you are agreeing not to copy, save, or reproduce images in any way other than backing up your digital files. This includes copying and saving images from websites, social media, or any there form of advertisement.
